Travellers Isle Holidays (Pvt) Ltd Service Agreement

By clicking ‘I Agree’ the customer is deemed to have read and understood the terms of service and agree to the terms of service of TRAVELLERS ISLE HOLIDAYS (PVT) LTD.

Your reservation shall only be confirmed upon payment in the manner setout herein and agreement to the terms of service.

‘TRAVELLERS ISLE HOLIDAYS (PVT) LTD’ or ‘WE’ welcome you (the ‘Customer’ or ‘you’) to its site. The terms and conditions / terms of use / terms of service (hereinafter ‘terms of service’) as defined below- apply to our services, directly or indirectly made available to you through online reservations, customer service requests or otherwise. By accessing, browsing and using the Site and/or by making a reservation through TRAVELLERS ISLE HOLIDAYS (PVT) LTD’, you acknowledge and agree having read, understood and agreed to the Terms of Service and the policies and guidelines, which should be read in conjunction with and are an integral part of these terms and conditions.

The terms and conditions set out below and the Policies are collectively referred to as the “Terms of Service”. If you do not agree to the Terms of Service, please cease use of the Site immediately.

The Terms of Service as may be amended from time to time constitute the entire agreement, and supersede any other agreements or understandings (oral or written), between you and the TRAVELLERS ISLE HOLIDAYS (PVT) LTD’ with respect to their subject matters unless explicitly stated otherwise.

Reservation

Reservations will be based on availability.

By making a booking through the Site, you make an offer to book a reservation at the price listed for such reservation and such other terms and conditions stated on the Site. This shall become a binding contract formed when accepted by TRAVELLERS ISLE HOLIDAYS (PVT) LTD. We reserve the right to reject bookings.

When rendering our services, the information that we disclose about tours / accommodations is based on the information provided to us by the providers.

Once the reservation is confirmed you will receive proof of the confirmation via an e-mail

General cancellation policy

There is a non-refundable fee per tour package on all received cancellation requests, regardless of the period when the cancellation has been submitted. The non – refundable fee shall be $300- $500 or $300 per person depending upon the selected tour package as set out herein.

All cancellations under different tour packages shall be subject to the general cancellation policy.

TRAVELLERS ISLE HOLIDAYS (PVT) LTD is committed to providing you with an efficient refund process and in the event of a cancellation, the appropriate refund shall be sent within 2 weeks from the date of such cancellation.

Any cancellation must be submitted and communicated in writing or via email to TRAVELLERS ISLE HOLIDAYS (PVT) LTD.


 

Transport Packages

Reservation for transport packages will not be confirmed until payment of an advance of 30% of the total package cost and acceptance by TRAVELLERS ISLE HOLIDAYS (PVT) LTD.

The remaining 70% of the total package cost should be paid to TRAVELLERS ISLE HOLIDAYS (PVT) LTD 14 days prior to the first date/ commencement date of the tour by the ‘customer’ or ‘you’.

The ‘customer’ or ‘you’ may pay the remaining 70% in two instalments, with 35% of the total package cost to be paid no less than 30 days prior to the first date/ commencement date of the tour, and the balance 35% to be paid no less than 14 days prior to the first date/ commencement date of the tour.

Any additional mileage used and or additional distance added shall be calculated and charged at the end of the tour which shall be payable to the representative named by TRAVELLERS ISLE HOLIDAYS (PVT) LTD.

If the ‘customer’ or ‘you’ failed to settle the payments on or before the payment due dates, TRAVELLERS ISLE HOLIDAYS (PVT) LTD has the right to reject the reservations. In such event the ‘customer’ or ‘you’ will be refunded according to the cancellation policy.

Cancellation Policy:

Any cancellation of your participation 60 days prior to the first date of the tour/ commencement date, shall be refunded in full, i.e. 100% of the of total money paid to TRAVELLERS ISLE HOLIDAYS (PVT) LTD, subject to $500 non-refundable fee.

Upon any cancellation made within 60 to 45 days prior to the first date of the tour/ commencement date, you shall receive a 70% refund of the total invoiced amount, subject to $500 non-refundable fee.

Upon any cancellation made within 44 to 30 days prior to the first date of the tour/ commencement date, you shall receive a 50% refund of the total invoiced amount, subject to $500 non-refundable fee.

Upon any cancellation made within 29 to 20 days prior to the first date of the tour/ commencement date, you shall receive a 30% refund of the total invoiced amount, subject to $500 non-refundable fee.

Any cancellation made within 19 days prior to the first date of the tour/ commencement date and /or failure to arrive  ‘no show’ and/or withdraw during the tour shall be treated as late cancellation and will not be eligible for any refund of the money paid to TRAVELLERS ISLE HOLIDAYS (PVT) LTD.


 

Small Group Tours

Small group tours : 1 to 10 guests

Reservation for small group tours will not be confirmed until payment of an advance of 30% of the total package cost and acceptance by TRAVELLERS ISLE HOLIDAYS (PVT) LTD.

The remaining 70% of the total package cost should be paid to TRAVELLERS ISLE HOLIDAYS (PVT) LTD 30 days prior to the first date/ commencement date of the tour by the ‘customer’ or ‘you’.

The ‘customer’ or ‘you’ may pay the remaining 70% in two instalments, with 35% of the total package cost to be paid no less than 60 days prior to the first date/ commencement date of the tour, and the balance 35% to be paid no less than 30 days prior to the first date/ commencement date of the tour.

If the ‘customer’ or ‘you’ failed to settle the payments on or before the payment due dates, TRAVELLERS ISLE HOLIDAYS (PVT) LTD has the right to reject the reservations. In such event the ‘customer’ or ‘you’ will be refunded according to the cancellation policy.

Any cancellation made within 19 days prior to the first date of the tour/ commencement date and /or failure to arrive ‘no show’ and/or withdraw during the tour shall be treated as late cancellation and will not be eligible for any refund of the money paid to TRAVELLERS ISLE HOLIDAYS (PVT) LTD.


 

Group tours

Group tours : above 10 guests

Reservation for group tours will not be confirmed until payment of an advance of 30% of the total package cost and acceptance by TRAVELLERS ISLE HOLIDAYS (PVT) LTD.

The remaining 70% of the total package cost should be paid to TRAVELLERS ISLE HOLIDAYS (PVT) LTD 60 days prior to the first date/ commencement date of the tour by the ‘customer’ or ‘you’.

The ‘customer’ or ‘you’ may pay the remaining 70% in two instalments, with 35% of the total package cost to be paid no less than 120 days prior to the first date/ commencement date of the tour, and the balance 35% to be paid no less than 60 days prior to the first date/ commencement date of the tour.

If the ‘customer’ or ‘you’ failed to settle the payments on or before the payment due dates, TRAVELLERS ISLE HOLIDAYS (PVT) LTD has the right to reject the reservations. In such event the ‘customer’ or ‘you’ will be refunded according to the cancellation policy.

Cancellation Policy :

Any cancellation of your participation 90 days prior to the first date of the tour/ commencement date, shall be refunded in full, i.e. 100% of the of total money paid to TRAVELLERS ISLE HOLIDAYS (PVT) LTD, subject to $300 per person non-refundable fee.

Upon any cancellation made within 90 to 75 days prior to the first date of the tour/ commencement date, you shall receive a 70% refund of the total invoiced amount, subject to $300 per person non-refundable fee.

Upon any cancellation made within 74 to 60 days prior to the first date of the tour/ commencement date, you shall receive a 50% refund of the total invoiced amount, subject to $300 per person non-refundable fee.

Upon any cancellation made within 59 to 45 days prior to the first date of the tour/ commencement date, you shall receive a 30% refund of the total invoiced amount, subject to $300 per person non-refundable fee.

Any cancellation made within 44 days prior to the first date of the tour/ commencement date and /or failure to arrive ‘no show’ and/or withdraw during the tour shall be treated as late cancellation and will not be eligible for any refund of the money paid to TRAVELLERS ISLE HOLIDAYS (PVT) LTD.


 

Important: since several luxury properties in Sri Lanka and Maldives have narrow free cancellation windows. TRAVELLERS ISLE HOLIDAYS (PVT) LTD reserves the right to modify the above cancellation policies with notice which would be provided to the ‘customer’ or ‘you’ via email prior to the payments.


 

Terms & Conditions

Participation requirements:

You must be in good physical condition to participate in this Trip. If you are taking prescription medication, please make sure you have enough before leaving. Any pre-existing physical, mental, or emotional disability that may require attention or special treatment must be reported in writing prior to the beginning of a Trip. Failure to do so may result in expulsion from a Trip at the traveler’s own expense. Please provide a valid email address and current contact information. TRAVELLERS ISLE HOLIDAYS (PVT) LTD may be sending out notices and information, most of which will be sent by email, including hotel information and receipts. It is your responsibility to notify TRAVELLERS ISLE HOLIDAYS (PVT) LTD of any address change. Please keep an open mindset and spirit of adaptation when traveling abroad, and remember that you will be in a different country with a different culture, different standards of living. All your personal information, address, emergency contact numbers, Trip Registration Form & Agreement, arrival information, etc, need to be in the possession of TRAVELLERS ISLE HOLIDAYS (PVT) LTD prior to the start of the Trip. All your information is strictly confidential and will not be shared with anyone.

 

Change in Trip Price :

All quoted prices may be subject to sudden changes, which is chargeable from the customer until balance is paid. Once the final balance has been paid, the price is locked, regardless of exchange fluctuations prior to the Trip taking place.

 

Travel Insurance :

It is your responsibility to seek information on travel insurance companies. Travel insurance is highly recommended by TRAVELLERS ISLE HOLIDAYS (PVT) LTD (to cover unexpected Trip cancellation, airline tickets, loss of luggage, trip delay, medical evacuation, etc.). TRAVELLERS ISLE HOLIDAYS (PVT) LTD does not sell nor provide travel insurance or health insurance. It is not mandatory to have travel insurance to sign up for this trip. Whether or not you purchase travel insurance, you will be responsible for all expenses incurred following loss or damage to your property, any unforeseen travel expenses related to going on this Trip (flight delays, strikes, airport shut-downs, weather conditions, terrorist threats, etc.). Purchasing health coverage is your responsibility. Please inquire with your own health insurance company on whether they offer coverage overseas and their policy on reimbursement. You are responsible for any medical expenses incurred in the event you become injured or ill during your Trip.

 

Travel documents :

You are responsible to carry a valid passport and for determining and fulfilling any visa requirements by contacting your country’s embassy. You must check with your own Doctor, if there are any vaccinations required for the Trip. Pregnant women: Must have a doctor approval in English for the flight and trip.

 

Accommodations :

Please let us know in advance of any particular questions or needs you have to make sure this trip is for you. In case of an over booking of a hotel TRAVELLERS ISLE HOLIDAYS (PVT) LTD is allowed to transfer the travelers to another hotel in the same range or above. The responsibility for that is upon the hotel.

 

Meals :

If you have allergies, special dietary requirements, glucose or other food intolerance, if you are hypoglycemic, vegetarian, vegan, lactose-intolerant, gluten-intolerant, diabetic, etc., please let us know in advance of any particular questions or needs you have in order to make this trip suitable for you.

 

Person Leading the Trip :

TRAVELLERS ISLE HOLIDAYS (PVT) LTD hires trained local professionals who will take you to the places you have chosen for the itinerary, so you can feel safe and at ease in any given moment of your vacation. Our mission is to make each traveler feel comfortable and have a relaxing experience in the Trip.

 

Excluded from the Trip Price :

You are responsible for your own airfare, so TRAVELLERS ISLE HOLIDAYS (PVT) LTD recommends purchasing plane tickets shortly after putting down your deposit for this Trip to insure availability. All transportation not expressed as included is not included. Taxi fare, excess baggage fees, forwarding of baggage, baggage loss, medical expenses, travel insurance, items or a personal nature such as laundry, optional trips, any meals not specified to be included, special arrangements not specified to be included, airport taxes,  extra charges and gratuities associated to your room are all not included. Trip package does not include any expenses related to any unforeseen travel conditions, weather conditions, flight delays, train delays, airport blockages, terrorism, strikes, and taxi fares. Price does not include items of a personal nature such as liquors, personal purchases, wine that is not included, restaurant gratuities, and gratuities to drivers and guides. Personal expenses such as phone calls, spa charges, room service, bar beverages, mini bar consumption, laundry, visa fees, airline excess luggage charges and other incidental extras are not included. Any other service not specified to be included in this packaged Trip is not included. Any travel expense not specified to be included is not included.

 

Responsibility :

TRAVELLERS ISLE HOLIDAYS (PVT) LTD, officers, directors, affiliates, collaborators, agents, associates, drivers, and all assistants and helpers to this trip act only as agents and guides for the travelers and assume no liability for any injury, damage, loss, accident, loss detention, annoyance, delays and expenses arising from the same, irregularity which may be occasioned either by reason of defect in any vehicle or through acts of default of any company or persons engaged in conveying the passengers or in carrying out the arrangements of the Trip. TRAVELLERS ISLE HOLIDAYS (PVT) LTD and its officers, Directors, affiliates, collaborators, agents, employees and assistants accept no responsibility for losses or additional expenses due to delay or changes in flights, trains or other services, sickness, weather, government and other civil authorities; restrictions and regulations, civil disturbances, strikes, war, quarantine, discontinuances to arrive or change in transit or hotel service, uncontrollable events, forces of nature, illness, criminal or terrorist activities of any kind, and or all other causes over which we have no control. All such losses will have to be borne by the passengers as trip rates provide arrangements only for the times stated. Baggage is maintained at owner’s risk.

 

As the Trip organizer, TRAVELLERS ISLE HOLIDAYS (PVT) LTD accepts no responsibility for securing, handling, or possession of passports or travel documents; nor for the accuracy of information given regarding such documents. It is your responsibility to make sure that you are in possession of the proper travel documents and are in compliance with the current carrier and government regulations. TRAVELLERS ISLE HOLIDAYS (PVT) LTD takes no responsibility for items forgotten at any of the accommodations where you have lodged at any time during the Trip. Rights are reserved at TRAVELLERS ISLE HOLIDAYS (PVT) LTD sole discretion to decline to accept or retain any person as a member of the trip at any time should such person’s health, mental condition, physical infirmity or general deportment impede the operation of the Trip or the rights, welfare or enjoyment of other Trip members. TRAVELLERS ISLE HOLIDAYS (PVT) LTD its officers, directors, affiliates, collaborators, agents, employees and assistants reserve the right to cancel or reschedule any tour/activity departure in accordance with operation requirements. Uncompleted portions of the Trip itinerary are not cause for refund.

 

Acceptance of Terms and Conditions

By clicking/checking the ‘I Agree’ the ‘customer’ or ‘you’ specifically agree that ;

you have fully read and understood the Trip Terms & Conditions, as well as the Trip Registration Form & Agreement relating to this Trip.

You understand the Cancellation & Refund Policy, as well as the deadlines for payment and for cancellation submission.

you warrant that you are aware of what is included and what is not included in this Trip and acknowledge that TRAVELLERS ISLE HOLIDAYS (PVT) LTD or its officers, directors, affiliates, collaborators, agents or employees are not responsible for any accidents including  food poisoning, drowning, allergy-related health problems, or any other harm or injury, but not limited to, that you may experience which may occur during your tour with us.

You are responsible for any expenses arising outside this agreement and/ or that relate to food allergies or particular dietary needs (i.e. vegetarian, vegan, diabetic, glucose-intolerant, hypoglycemic, etc.), which keep you from eating what is presented during the included meals.

You indemnify TRAVELLERS ISLE HOLIDAYS (PVT) LTD and all its officers, directors, affiliates, collaborators, agents or employees from ANY legal liability for any unexpected occurrence that may take place arriving to and/or on the Trip, and/or after the Trip is over and fully understand that TRAVELLERS ISLE HOLIDAYS (PVT) LTD assumes no liability for any lost or stolen items, injury or death for any reason (including but not limited to car or any other transportation related accident), terrorism, drowning, any injury or illness related to food intake or poisonings, or other medical problems.

You understand traveler’s insurance; personal medications and all medical needs are your own responsibility and not that of TRAVELLERS ISLE HOLIDAYS (PVT) LTD.

You are aware and understand that TRAVELLERS ISLE HOLIDAYS (PVT) LTD can make no refunds due to missed days, activities, or hotel accommodation because of weather conditions, as well as strikes an/or other unexpected occurrences during the trip.

It is understood that in the event you elect to forego any meal and/or activity for any reason, no refund for the meal and/or activity will be made and that you shall be responsible for any medical expenses incurred in the event of an injury, illness or any other occurrence outside the Agreement.

Because of the personal nature of the Trip, you shall be kind and considerate of other Trip members, if any, the Trip leader and assistants for your own benefit and the benefit of other Trip Members.

You agree to indemnify TRAVELLERS ISLE HOLIDAYS (PVT) LTD and its officers, directors, affiliates, collaborators, agents or employees from any claim or damage arising out of your own actions during the Trip.

This agreement shall be legally binding on you and your successors assigns, heirs, legal guardians and personal representatives, and shall be construed according to the laws of SRI LANKA.

There shall be no amendments or waivers to this agreement unless executed  in writing signed by all parties. Any waived breach shall not be considered the waiver of any additional breach.
